Terms of Service

MountDev is operated by Cascadia Web Services, LLC.

Last updated October 29, 2026.

In plain words: you pay per site, monthly, by card. Removing a service stops it at once, with a prorated credit on your next invoice. Filing a payment dispute or chargeback is your notice that you are ending your account: it is permanent, whatever the dispute's outcome, and the account closes at the end of that calendar month. You can export your data at any time.

1. Who These Terms Are With

These Terms of Service ("Terms") govern MountDev: the website at mountdev.app, the MountDev workspace, the Site Care plugin, the MountDev API, and the services described below (together, the "Services"). MountDev is operated by Cascadia Web Services, LLC, a Delaware limited liability company registered to do business in the State of Oregon ("MountDev," "we," "us," or "our").

"You" means the agency or other business that creates a MountDev account. If you accept these Terms for a company, you confirm that you can bind it. By creating an account, adding a site, or using any Service, you agree to these Terms and to the Privacy Policy, which is part of them. If you do not agree, do not use the Services.

The Services are for businesses. They are not offered to consumers for personal, family, or household use.

2. Definitions

  • Site: a WordPress website you add to your account.
  • Your Client: a person or business you serve and whose Site you add. Your Clients are your customers, not ours.
  • Client Data: the content, files, databases, and personal information on a Site or that you put into the Services.
  • Included Amounts: the allocations each Service includes for a Site, as shown on the Pricing page when you add it (for example, storage, bandwidth, monitored pages, and backup history).
  • Add-On: more of an allocation a Service already includes, priced per Site.

3. The Services

You choose, per Site, any of three services:

  • Maintenance: tested nightly updates with automatic undo when a live check fails, backups with a weekly test restore, malware and vulnerability checks, uptime, form, element, and visual checks, the link checker, the activity log, and the monthly report.
  • Performance: daily speed measurement and the optimizer, which changes how pages are delivered only after each page is proven in a real browser, and switches a page back at once if it later fails.
  • Hosting: each Site hosted on WP Cloud, the managed WordPress platform from Automattic, set up and looked after by us, with site email delivery and the Included Amounts shown on the Pricing page.

Each Service includes all of its features. What each includes, and each Add-On, is described on the Pricing page and in the docs at the time you add it. We may improve, change, or replace how a feature works, as long as we do not materially reduce what a Service includes during the month you have paid for. If we remove a feature you rely on, you may stop that Service at once and receive the credit in Section 7.

4. Your Account

You are responsible for your account, for everyone you give access to it, and for keeping sign-in details secure. Tell us at once at help@mountdev.app if you think your account has been used without permission. You must give us accurate business and billing details and keep them current.

5. White Label and Your Clients

You may resell the Services to Your Clients under your own name and brand, at your own prices. Reports, the Site Care plugin's name, and the portal your clients see may carry your brand. We do not contact Your Clients, sell to them, or bill them.

Because Your Clients are your customers:

  • your agreement with each of them, the price you charge, and the support you give them are yours;
  • you must have each Site owner's permission to add their Site, to give us the access the Services need, and to let us process Client Data as described in these Terms and the Privacy Policy;
  • you are responsible for what Your Clients do with the Services, and for passing on rules at least as protective as Section 12; and
  • if a Site owner tells us directly that you no longer have permission, we may pause the work on that Site and ask you to resolve it.

6. Fees, Billing, and Payment

  • Per Site, each month. Every Service and Add-On is priced per Site, per month, in US dollars, at the prices shown on the Pricing page when you add it. One invoice covers all your Sites, with each Site and Service as its own line.
  • Card on file. Fees are charged in advance each month to the card or bank account on file, through our payment processor, Stripe. We never store full card numbers. A payment returned by your bank may carry a fee of up to $25.
  • Adding mid-month. A Service or Add-On you add starts at once, and the rest of the month is prorated on your next invoice.
  • Hosting usage. Use above a Site's Included Amounts (storage, bandwidth, processing, and email) is measured as it happens, shown to you in your workspace, and billed in arrears at the rates on the Pricing page. We do not stop or slow a Site for going over.
  • Failed payments. If a payment fails, we will tell you and try again. If it is still unpaid 15 days after the first notice, we may pause the Services on your Sites until it is paid. Pausing never deletes Client Data.
  • Taxes. Fees do not include taxes. You pay any sales, use, or similar taxes on the Services, other than taxes on our income.
  • Price changes. We will give at least 30 days' notice by email before a price change takes effect for Sites already on your account.

Payment Disputes and Chargebacks End Your Account

If a charge looks wrong, contact us first at help@mountdev.app. We will look into it and refund any billing error. A dispute filed with your bank or card issuer is treated as notice to end your account, as described below.

Filing a payment dispute or chargeback with your bank or card issuer, for any reason, is received as your notice that you are ending your account. That notice is permanent: neither you nor we can reverse or withdraw it, whatever the outcome of the dispute.

  • Your Services continue until the end of the calendar month in which the dispute is filed. The account then closes, and Section 11 applies.
  • We contest disputes with our records of the Services provided and the charges you agreed to.
  • Any unpaid balance stays owed after the account closes, whatever the dispute's outcome.
  • Final backups are released to you only once the balance is paid in full.

7. Stopping a Service, Credits, and Refunds

There is no contract and no minimum. You may stop any Service or Add-On on any Site at any time from your workspace.

  • A Service or Add-On you remove stops at once.
  • The unused days of the month you paid for are credited, prorated by day, on your next invoice.
  • Hosting usage up to the moment a Service ends is billed on your next invoice.
  • Otherwise, fees are not refundable. Credits are applied to invoices and are not paid out as cash.

8. Suspension and Termination

We may suspend a Site or your account at once, with notice where we can give it, if: it threatens the security or stability of the Services or other customers' sites; it is needed to follow the law or a valid legal demand; or it breaks Section 12. We restore the Services as soon as the cause is resolved.

Either party may end these Terms for a material breach the other party does not cure within 15 days of written notice. You may also end them at any time by closing your account.

When the Services end on a Site, for any reason, Section 14 applies.

9. What We Fix, and What Stays Yours

We fix what we can on the Sites we look after: an update that breaks a live check is undone, outages on our hosting are handled by us, and problems our checks find are worked on by our team when they are ours to fix. Every issue we find is placed in one of three groups, and you can see which in your workspace:

  • Ours: the Services themselves, our hosting, and the work the Services include. We fix these at no extra charge.
  • Yours or Your Client's: content, design, plugin and theme choices, custom code, premium plugin licenses, domain renewals, third-party accounts, and anything only the Site owner can decide. We tell you what we found and what step is needed.
  • A vendor's: a problem in a plugin, theme, or outside service that only its maker can fix. We tell you, and we work around it where we safely can.

You and Your Clients own and are responsible for Site content, premium licenses, domain names, third-party accounts, and Your Clients' accounts. Where work beyond what a Service includes is needed, we will say so and price it before doing it; nothing extra is charged without your approval.

10. Access, Security, and the Site Care Plugin

The Services connect to each Site through the Site Care plugin and, on our hosting, through the platform itself. We use that access only to provide the Services. Sign-in links we create for you work once and expire after 60 seconds. You may remove the plugin or our access at any time, though some Services cannot run without it.

We use commercially reasonable security, described on our Security page. No system is perfectly secure, and we do not promise a Site will never be compromised. You are responsible for credentials held by your staff, Your Clients, and other vendors, and for code or plugins installed by anyone other than us. Each party will tell the other without undue delay of a security incident affecting the other's data.

11. Data, Backups, Export, and Portability

  • Your data stays yours. You and Your Clients keep all rights in Client Data. You give us a limited license to host, copy, process, and display Client Data only as needed to provide the Services.
  • We process it for you. For personal information in Client Data, you (or Your Client) are the controller and we are your processor. We follow your instructions, the Privacy Policy, and our Data Processing Agreement, which is part of these Terms when you accept it in your workspace.
  • Backups are kept for the history your Services and Add-Ons include. Backups are a recovery aid: we test them weekly, but we do not promise that every backup will restore every file. Keep your own copy of anything you cannot afford to lose.
  • Export at any time. You can download every record, report, and file in your account in one export, at any time, at no charge. Sites on our hosting can be moved to another host; we provide the files and database on request.
  • After the Services end, you can export for 30 days. A final backup of each Site is kept for the period your Services include (90 days unless an Add-On says longer), then deleted. While any balance is unpaid, final backups are not released (Section 6). Billing and tax records are kept as the law requires.

12. Acceptable Use

You may not use the Services, or let Your Clients use them, to: break the law; infringe anyone's rights; host malware, phishing, or deceptive content; send spam or email to people who did not ask for it; mine cryptocurrency; attack or probe other systems; or put a load on shared infrastructure that harms other customers. We may remove or disable content in response to a valid legal demand, a credible claim of infringement, or a security threat, and we will tell you when we do.

Site email sent through our sending must be the email a Site sends in its normal work (forms, orders, password resets, and similar). Marketing email to lists is not allowed through site email.

13. The MountDev API

The API lets you read your Sites, Services, reports, and usage (Reporting) and your invoices and billing (Billing) from your own tools. API keys are tied to your account; keep them secret and rotate them if they are exposed. We may limit request rates to protect the Services, and we will document those limits. You are responsible for what your tools do with the data they read, including data about Your Clients. We may change the API with at least 90 days' notice before removing anything a published version offers.

14. No Tracking

The MountDev website and the reports and portal Your Clients see do not use advertising trackers, third-party analytics, or tracking cookies. We do not sell or share personal information for advertising. The Services do not add tracking to your Sites.

15. Confidentiality

Each party will keep the other's non-public information confidential, use it only for these Terms, and protect it with at least reasonable care. This does not apply to information that is public through no fault of the receiving party, was already known to it, is received from someone else without restriction, or is independently developed. Either party may disclose information when the law requires, with notice to the other where allowed.

16. Intellectual Property

We keep all rights in MountDev, the Site Care plugin, the API, our reports' design, and our other software and know-how. You get a non-exclusive, non-transferable right to use them, and to let Your Clients see them under your brand, while your account is active. The Site Care plugin and other open-source parts are licensed under their own open-source licenses, which control where they apply. Suggestions you give us may be used without obligation.

17. Third-Party Services

The Services rely on outside providers, listed in the Privacy Policy, and on plugins, themes, and services chosen by you or Your Clients. We are not responsible for outages, changes, or actions of third parties we do not control, though we will work around them where we safely can.

18. Service Levels and Support

There is no uptime commitment and there are no service credits. Instead, we publish the uptime of the Services openly, so you can see how they have run. We aim to keep the Services available at all times and to fix problems that are ours quickly. Support is by email at hello@mountdev.app and in your workspace, answered in writing.

19. Warranties and Disclaimers

We will provide the Services with reasonable skill and care. If a Service does not do what these Terms or the docs say it does, tell us within 30 days; we will fix it, or, if we cannot, credit the fees for that Service on the affected Site for the period it fell short.

Otherwise, and to the fullest extent the law allows, the Services are provided "as is" and "as available," without other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Descriptions on our website explain how the Services work; they are not extra promises.

20. Limitation of Liability

To the fullest extent the law allows:

  • neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, even if told they were possible; and
  • each party's total liability under these Terms is limited to the fees you paid us for the Services in the three months before the event giving rise to the claim.

These limits do not apply to your payment obligations, to either party's indemnity duties, or to liability that cannot be limited by law.

21. Indemnification

You will defend and indemnify us against third-party claims arising from Client Data, from content on your Sites, from your breach of Section 12, or from claims by Your Clients about services you sold them. We will defend and indemnify you against third-party claims that MountDev software, as we provide it, infringes a United States intellectual property right. The party claiming indemnity must notify the other promptly and let it control the defense.

22. Force Majeure

Neither party is liable for a delay or failure (other than paying fees) caused by events beyond its reasonable control, including natural disasters, war, labor disputes, government action, internet or power outages, cyberattacks, and failures of outside providers. If such an event lasts more than 60 days, either party may end the affected Service, and Section 7's credit applies.

23. Governing Law and Disputes

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law rules. Before starting any claim, the parties will try for 30 days to resolve it informally by email. If that fails, either party may bring the claim in the state or federal courts in Multnomah County, Oregon, and both parties consent to those courts. Claims must be brought individually, not as part of a class. Each party waives a jury trial to the extent the law allows. A claim must be brought within one year after it arises.

24. Changes to These Terms

We may update these Terms. The current version is always at mountdev.app/legal/terms/ with its date. For a material change, we will email you at least 30 days before it takes effect. If you do not accept it, you may close your account before then, and the unused days are credited as Section 7 provides.

25. General

These Terms, the Privacy Policy, and the Data Processing Agreement are the whole agreement about the Services. If a provision cannot be enforced, the rest still applies. Not enforcing a provision is not a waiver. You may not assign these Terms without our written consent, except to a successor of your business; we may assign them to a successor of ours. Notices to you go to your account's email address; notices to us go to hello@mountdev.app. We are independent contractors; nothing here creates a partnership or agency.
